The NLV is initially valid for 1 year. After the first year, renew for 2 more. After 3 years, renew for another 2 (5 years total). Since Royal Decree 1155/2024 (in force since May 2025), each renewal requires proof of at least 183 days of physical presence in Spain per year — a meaningful change from the more flexible presence expectations of prior years. After 5 years of continuous legal residence: permanent Residencia de Larga Duración (Long-Term EU Residence) — no longer requiring private health insurance. After 10 years: Spanish citizenship eligibility.

183-Day Minimum Stay Now Enforced for Renewal
Royal Decree 1155/2024, in force since May 20, 2025, reinstated a 183-day/year minimum physical presence requirement for NLV renewal — a meaningful change from the more flexible presence expectations of prior years. Immigration authorities verify this through utility bills, bank transaction records, and flight history. If you plan to split your time between Spain and elsewhere, confirm your specific situation with an immigration lawyer, as falling short of 183 days can jeopardize your renewal.

The NLV Application Process & Timeline
Months 1–2 — Prepare Your Dossier
Order your FBI background check immediately — allow 8–12 weeks. Purchase your Spanish health insurance policy from a Spanish-regulated insurer. Secure your rental contract or property deed in Spain. Gather all income proof: pension statements, Social Security letters, dividend records, investment portfolio reports. Commission certified Spanish translations of all foreign documents. Month 3 — Apply at the Spanish Consulate in the US
Submit your complete NLV application at the Spanish Consulate with jurisdiction over your US state of residence. Spanish consulates cover specific states — confirm yours before applying. Processing typically takes 1–3 months. The NLV is strictly a consulate-obtained visa — you cannot switch from a tourist stay inside Spain. Do not enter Spain on a tourist basis and attempt to convert; this will not work and jeopardises your application.
After Approval — Enter Spain & Apply for Your TIE
Your initial NLV is valid for 1 year. Enter Spain and within 30 days apply for your physical TIE (Tarjeta de Identidad de Extranjero — Foreigner Identity Card) at your local Extranjería immigration office. This is your resident identity card and is mandatory. After 1 year: renew for 2 more years. After 3 years total: renew for 2 more (5 years total). Common NLV Application Pitfalls
Using a non-Spanish health insurance provider
This is the single most commonly misunderstood requirement. Foreign insurers — including major US international health plans — are almost universally rejected by Spanish consulates. Your policy must be from an insurer specifically authorised to operate in Spain and must offer comprehensive coverage with no copays, no deductibles, and no waiting periods. Do not purchase any insurance before verifying Spanish NLV compliance.
Underestimating or poorly documenting income
The €28,800/year threshold is a legal minimum — not a comfortable margin. Income must be proven as stable, regular, and passive. Vague statements, unverified transfers, or inconsistent income patterns are common reasons for rejection. Official pension award letters, notarised rental contracts, and broker investment portfolio reports showing recurring distributions are the strongest forms of proof.
Attempting to switch from a tourist visa inside Spain
The NLV is a consulate-issued visa that must be obtained from a Spanish Consulate in the US before you enter Spain for residence purposes. You cannot arrive as a tourist and convert to an NLV from within Spain. Attempting to do so is a common mistake that invalidates your eligibility and wastes months of preparation.
Delaying your TIE application after arrival
You must apply for your TIE (physical residence card) at your local Extranjería office within 30 days of arriving in Spain. This is a strict requirement — not a guideline. Book your Extranjería appointment before you travel, as availability varies significantly by city and season.
